General & Booking Conditions – Apartment Rental
1. General
These general and booking conditions apply to all reservations and agreements related to the temporary rental of the apartment by the landlord. By making a reservation, the tenant explicitly agrees to these conditions.
2. Reservation
A reservation is only definitive after written confirmation from the landlord and receipt of the full payment.
The landlord reserves the right to refuse a reservation without giving any reason.
3. Payment & Refund
The full rental amount must be paid within 7 days after confirmation of the reservation.
After receiving the full payment, refund is under no circumstances possible, regardless of cancellation or early departure.
In case of failure to pay on time, the reservation will lapse by law.
4. Deposit
The landlord may require a deposit.
The deposit will be refunded within 5 working days after departure, provided that:
the apartment is left in good condition;
no damage or additional cleaning costs have been established;
all conditions are met.
Costs will be offset against the deposit.
5. Arrival & Departure
Check-in: according to agreed time.
Check-out: at latest on the agreed time.
Deviation only after prior consultation and written confirmation.
6. Use of the Apartment
The apartment may only be used for tourist/recreational stay.
Living by more people than agreed is not allowed.
Subletting or commercial use is explicitly prohibited.
7. House Rules
Pets are not allowed.
Smoking in the apartment is not allowed.
Parties, gatherings and causing disturbance are forbidden.
The tenant must strictly comply with house rules and complex regulations.
8. Liability
The landlord is not liable for loss, theft or damage to personal belongings of the tenant.
The tenant is fully liable for damage caused during stay by himself or co-users.
9. Force Majeure
In case of force majeure (including but not limited to government measures, natural disasters or other unforeseen circumstances), the landlord has the right to terminate the agreement without any obligation to compensate for damages.
10. Complaints
Any complaints must be reported immediately during stay so that the landlord is given the opportunity to resolve them.
11. Applicable Law and Competent Court
Only Spanish law applies to this agreement.
Disputes will be submitted to the competent court in Spain.
